Annual leave during notice period

    Sorry to dig up an old thread but think this is the right place to ask rather than starting a new one.

    My query is this: I'm leaving my job, due to finish 4 weeks after I handed my notice & I have 2days of AL. My boss told me when handing in my notice 'If I needed to start early in my new role or wanted to take AL, we'll facilitate that' - So I'm taking my two days.

    Now however, HR have stated my manager has specified that I'm to be paid for any AL days accruing because I'm needed for the full month, and not to allow me finish early.

    So, I want to confirm that AL being taken is at the companys discretion & that I simply have to finish on the initial date or do I have a right to take AL owed to me, in order to finish up my employment a bit early. If I can take the 2 days then I get to finish on a Friday, on my birthday as opposed to having to come in until the following Tuesday

    They are entitled to do this - I think it's the one occasion where you can be paid for annual leave instead of taking it off.

    Was afraid that was the case. Was told that I'm legally entitled to the holidays so I should be entitled to take them as opposed to being paid for them

    My manager told me when I handed in my notice that 'If I needed to finish earlier by taking annual leave we'll help facilitate that' Now I'm hearing that my manager requested from HR that I work out the notice and not be allowed take AL. This gets my back up a bit that my manager couldn't have a word with me & ask himself - odds are I'd have agreed to it, but now I'm of the opinion that I'm due AL - I'm taking it

    Just wondering if anybody has been in this position before or has any suggestions on how to approach this?

    You can speak to your manager and ask for clarification but it's the company's decision when you get your annual leave. They aren't suggesting that you don't get what you're entitled to but just that it is paid at the end rather than taken in advance of leaving.
