Work questions

Two questions on behalf of a family member.

    1) Are employers allowed to make someone work for 7 days in a row? He gets the days off mid-week but never knows when this is going to happen so its hard to plan his social life or any personal arrangements or events.

    2) He is told he doesn't get paid extra for weekend work because the shop is open 7 days a week, and every day is a work day.

I think he is getting badly treated, but as he was unemployed for a long time he is afraid if he complains he will lose the job.

Would like some advice if possible please.

You can certainly work 7 days in a row, starting on a Wednesday you could work 10 days in a row till the Saturday week and still have two days off in both weeks.

There's nothing special about Saturday - it's just a regular working day.

Re Sunday working, you can read about it here: http://www.citizensinformation.ie/en/employment/employment_rights_and_conditions/hours_of_work/working_week.html#lcc038

But if it really is a 7-day operation, then the argument that any premium is included in the wages already is pretty strong.

Thank you for your replies. Indeed another family member has confirmed she has often worked 9-10 days in a row. Sorry I didn't check around the family now before I posted. Thanks again.

The rules about continuous working are that you're entitled to a full 24 hours off (i.e. a full day) in any 7 days, or if that's not possible, two 24 hour periods off in any 14 days.

So in theory an employer can legally ask you to work 12 days in a row. Even the 48 hour rule is crazy, you could be asked to work 12 days straight, finish at 6pm on a Friday and be asked to report for work again at 6pm on the Sunday. Giving you only one day off, really.

The main protections come in total working hours, which cannot exceed 48 hours per week on average. And rest periods must be a continuous 11 hours between the end of one shift and the start of another.
