How to organise sheriff to enforce judgement

    I have a judgement granted to me from a small claim but the person did not liaise with the judgement. Court advises I get sheriff to enforce judgement.

    Can anyone advise how to go about this. Solicitor not an option - the amount is 250 odd so a waste to pay a solicitor

    I think you've to give 5% plus expensives to Sheriff. Doubt there'll be a lot left out of €250 if that even covers it.

    Contact the sheriffs office in the defendants jurisdiction directly, usually based in the courthouse. The fee for lodging with the sheriff for a small claim is e9.50. Any additional fees such as court messengers fees and mileage are payable by the defendant. Be warned though, sheriff is not always successful, it may be returned to you marked Nulla Bona I.e. no moneo no goods.

    I can advise you not to bother going down this route. I had a judgement issued to me against <Mod snip.> who damaged my personal property. I took the matter to Small Claims who issued a decree for the Sheriff to collect. I was told I would have to pay €9.50 and I would receive this back if my case was successful the matter would take 6-8 weeks. He got a Bailiff to go collect the money and I was advised this would take six weeks. Every time I contacted the Bailiff in regards to this I have been met with "Stop annoying me about this, I'm just back off my holiday", "The lad is a good-looking chap" (Needless to say, this has nothing to do with the case and I still can't figure out why this is mentioned by him every time we called) and "Look I've done everything I can, I can't do anymore, stop annoying me". Needless to say 1 year later, I was told they'd collected €300. When I asked if this could be sent out 10 months after the Decree was lodged, I was told 'Of course, it'll be after Christmas before you get it though'. I received a cheque with €223.50 a few weeks later and a letter stating they'd tried to collect the rest but the shop had no goods to seize and he'd refused to pay the rest. The other €65+ was to pay the Bailiff and Sheriff but they'd been unsuccessful so I lost the €9.50 lodgement fee too. I was never told I would have to pay anymore than the €9.50, I assumed this covered the cost of getting my €468 back.

    I issued a complaint against the Bailiff to the Sheriff's office on December 28th 2015 and as of March 5th 2016, have heard nothing.

    Don't waste your time!
