Customs-can you refuse item?

    Hi,

    I ordered a car part from china, I have now received a letter from revenue asking for an invoice so they can calculate tax.

    I dont want the item anymore and will be returning to the seller.

    I notice on their slip it said if I dont answer within 14 days they may return the item. Is it possible to refuse the item and will they post it back without me having to pay or will they agree that if I dont accept the item I can pay to post it back?

    5hit,do you know are they reasonable? If I offer to pay them the postage cost will they post it back

    Their charges dont make sense either. they say if the value is up to 150 euro you wont get charged customs but then once it is a cent over it appears they charge customs on the whole amount rather than any figure above the 150 euro.

    Their charges dont make sense either. they say if the value is up to 150 euro you wont get charged customs but then once it is a cent over it appears they charge customs on the whole amount rather than any figure above the 150 euro.
    That would be because that's how the law is written...

    They probably calculate import VAT (23% or whatever VAT is) and duty on the shipping cost (3% or whatever duty is).

    Even if they send it back, that doesn't get you a refund from the seller. Seller upheld their part of the bargain so if they receive the item, they don't have to give you a refund

    FWIW I hope the government doesn't pay to send items around the world in circumstances you're describing. It's not their job.

    I thought the postage paid by the sender also includes the return to sender if needed, for that reason you are always told to handed back to postman if you change your mind or need duplicate shipment, so nobody would need to pay for returning to sender. Maybe there's some exceptions to that.


    EDIT: After searching on google, I found the following document
    13 Incomplete Declarations/undeclared goods
    Any information omitted from customs declaration forms can lead to delays in receiving your package, as it will need to be opened to ascertain if the goods are liable to import duties. Generally, Revenue will write to the addressee requesting a copy of the purchase invoice for the goods or where this is not available a pay-pal receipt or a print-out from the internet detailing how much the goods cost. If a reply is not received within 14 days the package may be returned to the sender.
    As an incorrect or false declaration may lead to seizure of your package, it is important that you inform the sender of the necessity to complete the declaration accurately with all the necessary information.

    It does get me a refund, they specifically state if returned within 30 days they will refund. I think I'm just gona tell customs to keep it and do what they want with it, it will cost me 50 just to ship it back to the seller. 160 euro lesson learned.

    Vat will be on the amount once it is over €22.

    Customs duty (different to vat) will be on the total amount once its over €150 - customs duty varies from zero to 14%+

    Many car parts have a duty of 2.7%, so it is just 2.7% duty additional for over €150 - vat would ahve applied anyway.

    Sp assuming total cost of €160 including delivery

    duty €4.32
    vat €37.79
    an post fee €6

    Total due €48

    If the item was €149.99

    Vat 34.50
    An Post fee 6.00
    €40.50

    Customs won't return it - it will just lie there as "uncollected" and eventually destroyed or sold off.
