    Their tweet is a bit confusing, nothing illegal about drinking a can of beer whilst driving, it's the fact he/she was over the limit that got them in trouble.

    I'd just put the wording of the tweet down to poetic license. It's more 'sensational' to include that they saw the driver actually drinking alcohol.

    I assume they breathalysed the driver and he/she was over the limit and failed the test.

    A FCPN would tell me they were given points for careless driving or being a twat - they must have passed the breathalyzer.

    You can get an FCPN for being over the limit also, a furher read of the comments shows the driver was indeed over the limit.

    I thought if you were at the FCPN level, it would be dealt with by the side of the road and would only lead to a station visit if you refused to accept the FCPN?

    they still need to do the test at the station. I dont think the portable devices can be used as evidence.
