Hi. 2 weeks ago I traded a car in towards another car in Autolink Motor Company in Blanchardstown. I was told by the salesman that I wasnt to take the log book from my old car and post it and that he insisted that I would never hear from my old car again. After I received the log book for the new car I checked to see if my old car was still in my name and it was.

I tried ringing him last week and then txt him telling him that the old car was still in my name and I asked him to post the logbook to clear it from my name. I still havent heard back from him.

I just got off the phone with the tax office in Shannon and they said the old car is still in my name.

Im a bit concerned about this as the sales man told me that he regularly used the car that I bought from them. It had an extra 2000 miles on the clock compared to their ad on their website, so he told me he uses the car and thats why.

What can I do about this? Im prepared to do anything really as he is being a bit of a snake.

Also on the receipt that the salesman gave me, he wrote that I have no guarantee with the car I bought from him as I traded a car in towards it and that I inspected it. I thought nothing at the time but a few people have told me since then, that they are supposed to give me 3 months guarantee by law.. is this true?

Its common practice within the industry that they dont change the drivers name on the car when selling to a garage.

Everyone gives the log book to the garage when they trade in their car. Otherwise you would be adding an extra owner to the car.

Not happy about someone driving around in a car in my name. He has told me that he put over 2000 miles the car I bought from him since December

the person in Shannon said he could have put the car into the garages name

He will only change it over when they sell it on. If there is any issue arises in the meanwhile, you should have your receipt showing that you traded it in.

Never thought of that actually. Cheers!

    What about the guarantee though?

Buying a Used Car - Citizens Advice
...(when buying from a dealer)...as a consumer, are protected by the Sale of Goods and Supply of Services Act 1980 as you are buying a car for your personal use from a person whose normal business it is to sell cars. As a consumer you have the same rights if you buy an item second hand as if it is new. In this case if you find a fault with the car after you have bought it the dealer is the person who must set matters right.

I've heard and always assumed there was a legally required three month warranty on all second hand cars sold by a dealer but I can't find anything in writing. The closest is the following which I suspect is where it came from:
If you have a problem with a used car that you have bought you should, in the first instance, bring the car back to the garage or dealer who should be able to repair any problems that you have. If you have done this and are still dissatisfied you can then take your complaint further. If the dealer is a member of the Society of Irish Motor Industry you can use their Investigation and Complaints service. You need to contact the SIMI within three months of the fault becoming apparent.

Most second hand car sales will usually have at least a three month warranty which only covers engine and gearbox and not regular wear and tear. Regardless of what warranty they claim to have given you (or not given you) you are still covered by the 'Sale of Goods and Supply of Services Act 1980' as mentioned above, however the legislation doesn't give specifics on a time period or exactly what's covered so it can be assumed that it's something 'reasonable' which is highly subjective.

You should have sorted that before you bought it. Best you would have got is 3 months engine & gearbox probably. Not sure where you stand legally but am sure it wouldn't really be financially viable to pursue through the courts.

Run your old reg through - https://www.motortax.ie/PSE/start.do;jsessionid=0aa0114830d8986478c489434bd5b848cb7b491c0e1c.e38PaNaSbhuOay0Oe0?page=welcome

It should say "Purchased by a Dealer on : XX/XX/2016" if it is out of your name.

If it doesn't say anything, then the dealer hasn't done what the dealer is supposed to do, and you are liable for any fines / tolls etc.
