    What exactly is involved in medical discovery in a personal injury case

    Does the GP hand over your entire file or is it just the parts revelant to the injuries

    In a PI case, the Defendant is usually looking for medical evidence/documentation from the Plaintiff.

    The Plaintiff will take up the evidence which is within his reasonable procurement and will hand over the required categories of documentation to the other side.

    The Plaintiff will look at the request for voluntary discovery from the other side/ order for discovery, will make reasonable attempts to get hold of that info and then hand over the necessary, with an accompanying affidavit.

    Will the Plaintiff take up his entire file from his GP? Maybe not, unless he is required to do so.

    If the Plaintiff takes up his entire file from his GP, will he hand over the entire file to the other side? He will hand over the required documentation per the order for discovery (or the request for voluntary discovery), and he is unlikely to hand over anything else relevant that he is not required to hand over.
