1977 extension - retention required?

    Hi Folks,

    Bought a house recently built in the 60s. It's a semi d with a garage, the previous owners built an extension above the garage, adding two rooms upstairs. 4.65*2.45 and 3.95*2.45 (approx 21 sq metres)

    The extension has been there since at least 1977 as it had been built before other neighbours arrived.

    Assuming there have been no objections / enforcements made do we need to apply for retention?

    Is the local authority obliged to grant retention permission?

    We are looking to add a rear extension (approx 3.6 x 4.1 or 11.5 sq metres) As the the proposed extension combined with the existing extension is less than 40 sq metres. is planning required?

    Yes you need retention permission. The LA is not obliged to grant it, and may refuse it.
    You need planning to regularise the situation as you cannot get permission for any other works on a site that is not planning compliant.

    You can lodge the retention for the side works and permission for the rear works in one go in one application.

    there is the statute of limitations which means they cannot make you take it down, but that doesn't mean it is planning compliant. So yes you should apply for retention... any future sale/planning application could run into issues without it being compliant.
    Are they obliged? no but unless there is something very strange about it they generally will. if you have your own effluent treatment on site, id expect a report to be asked for to see if it was fit for extra bedrooms

    kceire and overshoot - thank you both, very prompt and very helpful. I had assumed retention was needed and hence one planning app to regularize all. Had a slim hope the date of construction might have helped me! Thanks MAJJ
