Santa Trains and refunds

    I'm use to events companies saying no refunds if you decide to cancel, but what about then they cancel? We've got a Santa Train booked for today. It's obviously not happening because of the storm currently hitting the area. Their website says "There are no refunds in the event of cancellation due to adverse weather conditions".

    This seems a bit mad. Can they do this?

    On the one hand I'm sure the arguement is "Well, it was in the terms and conditions before you bought so you made your purchase with knowledge of that condition", but on the other hand, a company can't just spout any old BS in their terms and expect it to be legally binding.

    They'll most likely offer you an alternative date. Ring them and see what they say first.

    It seems he'd rather they gave a refund than just holding on to all the money.

    In general, if you book a service and the supplier can't go through with it, then you'd be entitled to a refund. Putting a clause into the terms may not be enforceable, but you'd likely have to fight them for a refund. If you booked with a credit card you can contact the bank and ask about a charge back. If not, you can try the Small Claims Court for a refund.
