    It's a bit of an odd one as Certicom already have pretty strong patents around ECC and have had so since the 90's. Given that I don't see this going very far as it's pretty well established 'prior art'.

    It seemed to me that the Schwab defense was weak in not mentioning prior art. Netscape developed SSL specifications in 1994. This patent dates from 2001 - and was bought recently by a non-practicing entity that does not even have a website. Which entity is based in the court-fiddle land of East Texas. It appears that some companies have settled out of court. This provided cash for these *astards to take on other entities. It is strange as I previously said that there were no banks listed..... ie those with deep pockets.

    The Schwab (with all due respect for the parties involved) defense looks as if it was drafted by a newbie ultra junior associate, clueless about the technical issues, with a chargeout rate of perhaps $500/hr or so. As they say you gets what you pays for. The other issue is one of epileptic curve crypto. Does the case apply to all ssl or just some variation thereof?
