Data Protection and credit card details - a question

    Many months ago I provided my credit card details for a once-off transaction with a vendor.
    In the last month they have taken further payments from my account using the card details which they retained. (no fraud, just incompetence)
    I thought that this retention of details was only allowed where there was an ongoing need to retain the data. This was not so in my case. So I felt they were in breach of the act.
    I wrote to the DPC to verify if I was correct.
    They replied as follows:

    "This would appear to be more of an issue of the company's compliance with card scheme rules (i.e. terms and conditions merchants agree to if they offer credit card facilities). As the Irish Payment Services Organisation, is the representative body for the payments industry, you may wish to contact them in this regard"

    Seems I was wrong? Any views?
