implied terms of contract

    Hey all

    Just wondering about implied terms of contract...

    Its a term I vaguely remember from contract law in college. My understanding of the term was that if for example;

    An employee, works 5 days a week with Sunday and Wednesday off. And they have worked under this arrangement since day 1. And have done so for 2-3 years.

    Can the pattern of days off be considered a term of the employment contract. An implied term of contract...

    Or am I going crazy, and creating false memories from college ha ha

    An implied term is one created by practice.

    If my contract says 9 to 5 but my work practice has been 10 to 6 by informal agreement it can become an implied term.

    Depends on how long the practice is and the nature and requirements of the job

    Hard to know really. Definitely have a shot but you are going to be against it.
