Proving extension existed pre-Oct 1964

    According to DCC Planning Guidelines:
    "If the proposed extension is in addition to an existing extension (post 01-10-1964), overall areas of all extensions must not be more than 40 sq. m. - including extensions which needed permission, e.g. to side of house"

    My understanding of this is that if you had an extension that was built in the 1950's it looks like you can knock that old extension and build a new extension of 40sqm plus the size of knocked extension and not need to go through planning. Is this correct?

    If so, how would you prove that the old extension was built pre-Oct 1964?

    It actually does not matter when the extension was built, you can demolish and re-build up to 40 sq. metres, but if keeping the 50's extension, then you will need to prove it, for the new extension to be exempt up to 40 sq. metres. The remaining conditions re exempt extension are:

    I would submit the plans to the council and get an exemption certificate. I would never certify exemption myself for the sake of an €80 planning fee. Let the planning department certify

    They won't certify the exemption. They just state whether planning is required or not.
    You still need to engage an architect/surveyor/engineer to offer an opinion or certificate of exemption (should you ever need to remortgage or sell).

    And how are the date of works verified (to say an extension that may have been built before the planning regulations, 01 Oct 1964)?

    Should the solicitors for the owners of the property supply written confirmation of this?

    Evidence could be old photos, ordnance survey maps, affidavit or similar.
