Query about notice/annual leave

    Hi folks,

    I have been in my current job ~15 months and for mental health reasons (incurred by my job) I want out. I intend to hand in my notice next week. I have 11 days annual leave left, so a few questions in relation to that:

    1) Can I take this annual leave as part of my 4 week notice period?
    2) Am I legally due to be paid for untaken annual leave upon departure?

    My contract says use-it-or-lose it with regards annual leave but this is with regards the end of the year, not when notice is given.

    Just want my ducks in a line before I hand it in. TIA!

    You may not have eleven days left if you leave before the end of the year.

    You can request to take the leave you have remaining during your notice period, but that is at the discretion of your employer, who can pay you for the outstanding days instead when you finish.
