I'm always disgusted, but never surprised by these kinds of rulings... :(

10 years down to 9 - i thought it was going to say suspend it all. And I wouldn't have been shocked

Are you actually suprised we've honestly got one of the worse legal systems and judges in Europe I believe.

  • Registered Users, Registered Users 2 Posts: 12,033 ✭✭✭✭Richard Hillman

So basically the judge is rewarding them for the reason that they are so devoid of humanity that they will probably offend again. He is basically saying "these guys will probably do it again if we are not nice to them".

It is genuinely getting to a stage where vigilantism is becoming a viable option.

WTF was an 11year old doing going around with them

Not a bit surprised be the judge though

So one must now be given 'incentives' to not abduct, beat and gang rape? If the judge feels that they have such high probabilities of re-offending then surely the only actual course of action is to keep them locked up for longer?

Actually what kind of fúcked up logic is that? In 10 years they will be likely to re-offend and wont be rehabilitated.....so lets release them in 9 years instead?

Baffling and insulting to the victim, but hardly surprising.

Mr Justice Mahon said they went out that night with the intention of subjecting one or more women to the dreadful ordeal experienced by the victim. Despite their ages, they were “experienced in criminality beyond their years”, he said, and perhaps this fact lead the sentencing judge to comment that each of them had “left their childhood long behind”.

"and therefore I have suspended the last year of your sentence"

Compared to Italy, France, Russia, Greece, Hungary, Bulgaria, Croatia and an awful lot of others our legal system is actually quite good. Just saying.

Tell that to the victims we see week after week year after year on here let down by judges repeatedly

Why would I want to do that?

You made a silly thanks-whoring comment, I responded by pointing out that there are many other countries with legal systems that makes ours look pretty decent in comparison.

I remember this case when it was in the papers, would I be right in thinking these chaps would be from a much maligned, upwardly mobile 'community'?

  • Closed Accounts Posts: 3,389 ✭✭✭NachoBusiness

And the woman that took part?

Who took off her underwear and rubbed her self on the victim. Did she appeal her sentence?

Our legal system may be good, but it favours the criminal a bit too much.

Does it matter?... Would you feel the need to point it out if they were black?
Doesn't matter what community they are from. They are animals.
Rapists, like child molesters/abusers should never be released into civilisation again. There is no rehabilitation for that kind of warped mind.

I would tend to agree, we have a very serious problem in this country with locking up dangerous people, I have no problem with people getting a second chance for minor crimes, but it seems our judges give all kinds of criminals far too many chances

a case below is a perfect example

    http://www.independent.ie/irish-news/courts/maniac-taxi-driver-with-62-previous-driving-convictions-drove-himself-to-court-despite-being-banned-34139765.html

I fear there will be a very sad end to this story, innocent people are going to die, its almost a racing certainty, and yet he won't be locked up

Just offering a little counterbalance to the portrayal in some progressive circles that all travellers are victims like in "1950's Alabama".

These acts of violence are endemic within the travelling community, and a lot of people would do well to remember that.

I fully agree with you on the other points though. I've said before that we need a super-prison with a 5000 bed capacity to even make a dent in the criminal classes operating here.

They can get a year off in exchange for having rapist branded on their foreheads. No one gives a **** about their backgrounds.

Who said gang rape was endemic? My precise words were: "These acts of violence are endemic within the travelling community, and a lot of people would do well to remember that."

So yes, I was correct in saying these acts of sexual violence are indeed endemic within the travelling community, as proven by a link from Pavee Point themselves. Would you like to stop digging at this point?

  • Registered Users, Registered Users 2 Posts: 17,495 ✭✭✭✭eviltwin

Violent acts in general are much more common and normalised in the travelling community, it's not that much of a surprise surely?

  • Closed Accounts Posts: 3,389 ✭✭✭NachoBusiness

I despise men like them. Ten years was not even enough in the first place. I despise the system bowing to them.

In the context of our justice system, 10 years could easily be argued as being somewhat excessive, especially given their ages, lack of previous etc, hence the appeal. Murderers are walking our streets after having served not much more.

This case made odd reading at the time, given that the woman could not remember how she got into the van, but yet seemingly had no trouble remembering everything which took place within it, including a woman taking part by the way (which for whatever reason I can't seem to find what sentence, if any, that she received) and also that they gave her a lift home. Two of them also claimed they penetrated her and she claimed that was untrue.

Not saying things didn't unfold as she maintains, as the fact that her money was stolen, she had bruises, and her car was taken, make it quite clear that she wasn't exactly a willing participant in the night's activities, or all of them at least. A strange case by anyone's measure.

Don't derail the thread for your own shallow bs pointless reasons. It's about rape and the punishment for rape. Show some fcuking respect.

Your playing with words...by saying these acts wee endemic it's not unreasonable to assume you were referring to the case you were commenting on??

No where in the link did it say this was endemic

You do realize that if we stuck to the 'don't complain about our situation because there are others in much worse off situations' line of thinking we wouldn't be allowed to point out flaws in anything at all?

Bad meal in a restaurant? But there are babies starving in Africa.
Misdiagnosis by your doctor? Some people don't even have access to one.
    Ad nauseam.

The sentence reduction in the OP is ridiculous. Irrespective of other countries legal systems.

Why so hostile? I was responding to another poster. And what the attitude towards women in the travelling community is certainly valid when it comes to the safety of women. Or is it not politically correct to say that?

There is a reason why residents in Carrickmines don't want to live despite the recent tragedy near travellers and this story and other horror stories like it explain why.

I was responding solely to a comment saying that we have the worst legal system in Europe, by any objective standard we clearly don't.

Does our system need improvement? - IMO yes it does.

Should the scrotes in the OP have had their sentence reduced? - IMO, no if anything they should have had their sentences increased.
