Inheritance money

    Hi,

    Does anyone know the answer to this query ?

    If a person is seperated from their spouse, not legally and the spouse inherites money from the sale of a house that was left to all the brothers and sisters due to the death of their father. Is the seperated person entitled to half of that money?

    No.

    But if the separated couple later end up in court arguing about a financial settlement, all the assets of both the spouses are "in play" - as in, the court will take them all into account in deciding what financial and property orders to make. That includes the proceeds of the sale of the house that one spouse received (if the spouse concerned still has the proceeds, of course, and hasn't spent them).

    It's not him that has the debt... It's me . I've taken out a loan to put out daughter through UL .. I didn't ask for your opinion on debts , I asked for opinions on inheirtance . Can you go away and crawl under your rock now? Im under enough pressure as it is

    Answer is no I'm afraid. Your daughter will appreciate you got her through college and in the long run that's worth more than his money and the stress of courts and solicitors.

    No is the simple answer. However as mentioned above in the event of a Judicial Separation or Divorce such an inheritance could be part of his assets for consideration by the Courts.
