my foreign friend borrowed my motor and was flashed by a camera, he only had his original license and didnt have an irish one. he moved back to his country since the incident but sent me all his details to put on the nomination and he got a letter in the post from the garda (only because i put his foreign address on nomination i guess). hes saying he's not going to bother paying it. i told him he might be better off paying it and he probably cant get any points on his licesne anyway so for the sake of 80 quid just pay it so theres no trouble if he comes back to ireland. im also worried it doesnt get paid that itll come back to me since im the owner of the car.

would anyone know if hes going to end up in any trouble if he doenst pay and what about me?
    cheers!!!

    You're in the clear.
    http://www.irishstatutebook.ie/eli/2015/si/333/made/en/print
    (3) If you comply with subparagraph (1) above you don’t need to make a payment referred to in paragraph 1 of this notice, and a prosecution in respect of the alleged offence will not be initiated against you.

As for your friend, the judge could decide to proceed with the case in his absence or issue a warrant for his arrest or dismiss the case. None of this is enforceable outside Ireland so he can only get into trouble if he returns here and the Gardaí find out. As he has no Irish licence any points will against a 'ghost record' and only apply in Ireland, these won't affect his license outside of Ireland.

cheers for that. I think he would like to come back to ireland at some stage, even just to visit, so would he be best off just paying the 80eur to avoid trouble?

what way does a ghost license work? is it against the drivers name or foreign license or what and what would happen if say someone got 12 points on that ghost license. also would the 3 points disappear after 3 years like they do for irish licenses?

Held against the driver. If a driver gets 12 points on their driving record they are banned in Ireland only. Points expire as per Irish licences.

Not sure how it would work with summonses etc. if it's ignored. I paid mine and got the three points.

If you have a foreign license and convert it to an Irish one to the points transfer from the ghost license?

    Yes.

The points don't expire until 3 years after the driver gets an Irish licence, they are dormant until then. So someone can build up enough points on their ghost licence to be banned the second they get an Irish licence.

No, that isn't how it works. A driver with a non-Irish licence gets an Irish driving record to track any points.

It is all explained very clearly online and on the letter you get.

All that's not up to date.
There is not such thing as "ghost licence" anymore. It has changed with

Now no matter if you have Irish licence or foreign licence, points are awarded to you in normal way. They expire after 3 years, and if you manage to collect 12 points you will get banned.
In case of Irish licence they will ask you to surrender it, so you won't be able to drive anywhere.
In case of foreign licence, they will just ban you to drive in Ireland.

    cheers for the replies lads,

Cinio based on what you say above, the 3 points would only show up to Irish garda, right? I mean if the guy pays it and gets 3 points, the points are only applicable in Ireland, yea?

So if he doesn't plan on driving in Ireland any time over the next 3 years and doesn't want any hassle over not having paid the fine if he re-enters Ireland, best hting is just pay 80eur and he'll get 3 points that only apply should he drive in Irelnad? He would still have 0 points on his license as far as his home country and insurers in the country are concered?

Apologies for the thread drift but is there any way to check if you have points on your licence...? I got one speeding fine on my foreign licence several years ago, I have since swapped my licence for an Irish one and I was wondering if there were any points associated with it...?

Points issued a country only apply to that country, there is no mutual recognition of points between EU countries in operation yet.
