Part completed Section 47 House for sale

    Hi there,

    We are interested in buying a part-completed house which has a Section 47 condition on it. The Section 47 agreement was signed in 2006 but the house is not completed internally and is still at a builders finish.

    We are not locals so would not comply under the Section 47 condition (although I'd happily keep a couple of animals and have a small holding for a couple of years if it would help!)

    The planning history, from the online documents I can see, is quite complicated with original permission granted in 2006, extension to original permission granted in 2011 and various compliance issues. I'm going to talk to a solicitor and the council, but I'm assuming the council won't talk to me about a specific case, so I was wondering what general advice could be given here. Is there any possibility of it working out, or do we walk away?

    get the vendor to approach the council, cap in hand, and request a letter to state they wont be enforcing the section 47 condition due to economic reasons of the vendor.

    From a Council perspective your are solving a problem with a half finished house so they should be accommodating.
