Completion date has passed on sale

    The other parties solicitor had completely ignored letters asking them to complete so a completion notice was issued. The completion date has passed and their solicitor is sending through nonsense queries but will not issue funds or agree to close.

    My solicitor thinks we cannot enforce the completion notice as they are making shapes that look like interaction and an attempt to cooperate but I am seeking a second opinion as my solicitor wouldn't have a huge amount of experience in the area.

    My expectation on issuing a completion notice is that it would make the sale cut and dried, pay up or forfeit kind of thing. But instead it's all still as frustrating and even more of a mess. Also the other party has been accessing the property without permission.

    Can anyone help?

    From my limited experience in conveyancey you or they appear to be able to do anything you want. Deadlines mean nothing, getting a response at all or in a timely manner is rare. It basically seems like anything goes, don't believe anything you are told and expect the worst and for it to take longer than you ever could have believed.

    I'm in the middle of it at the moment. I was doing all the chasing and it was stressing me out. I gave up chasing, I figured I'm the one doing the paying (solicitor) and buying (from vendor), why in the name of God am I doing all the chasing? So it's still moving as slowly and I couldn't care less now. EA has been on to me asking how are things going, told him I hadn't a clue and I was sick of chasing everyone! There seemed to be some movement after that conversation, vendors solicitor was in contact with my solicitor.

    If your solicitor doesn't have much experience then perhaps you need an experienced solicitor to do the job.

    In any event, you are in a contentious situation and although you have phrased your query in such a way as to ask if anyone can help, this is an an indirect request for legal advice, in all of the circumstances. The real answer is that an experienced conveyancing solicitor can help and other people, including those who may be online, probably cannot.

    You need a competent solicitor to assist you and to give you definitive answers regarding how to complete the sale. You are not going to get that advice here.
