Driving Ban

    Hi, looking for advice.

    I was banned 18 months ago in my absence.

    I was banned for not producing a license and insurance. At this time I was insured and also had license, tax and nct. I missed the court because I didn't recieve the summons.

    I also missed the appeal date because I wasn't even aware I was banned. I applied for an extension of appeal and had to have forms signed and brought back in 7 days I think. Anyway I didn't and couldn't appeal again.

    I was told I could appeal after serving 2/3 of sentence which is now. But I was also told that it would cost basically €1500 legal fees.

    Can I appeal on my own ? Without a solicitor? If so how do I do this ?

    As far as I am aware you can do this yourself,
    Wether you get your licence back will depend a lot on what exactly you got banned for ?

    It was for driving without a license and insurance. Because i didn't attend they assumed I didn't have those obviously.
    Do u know how I can appeal ? Or where I go for advice. I don't have spare cash for solicitor

    Jes, that's tough. I'd seek legal advice when it comes to something as important as license etc. Wouldn't cost much to visit a solicitor for 30 Mins to familiarise with the issue.

    Failure to produce is an offence in its own right, ie you can still be convicted even if you have a licence/insurance. Why did you not receive the summons? Are you trying to overturn the convictions or simply applying for a termination of the ban post serving 2/3rds of the sentence. That's an important distinction.

    Burden of proof will be on you OP I believe to show that the you were never received a summons to court.

    Who is it that is telling you these things and seeing as they are obviously full of knowledge why are they not telling you what you need to do to get out of your mess?

    I would suggest you collect all the FACTS together in writing and go make a free legal advice appointment in your local Citizens Information centre.

    You would be applying for the early return of your licence.
    Not an appeal
    As far as I am aware you go to the court clerks office at the court you got the ban and you will be assisted there with form filling etc.
