Getting a patent is hard. So employ the services of a Patent Agent...expensive but really worth it.

Is it a simple idea?
They're the best apparently.

1. Patent search, to make sure no one else has thought of it first and it's not in development already. Then submit basic design and apply for patent. This will cost a fortune.
2. Venture capital, get people to fund your brilliant idea to prototype stage, then design and build, then rebuild, then build again until it works. Or abandon it, when it becomes clear that the concept and the practical reality are two different things.
3. Spend 100's of hours of man time researching it's marketability, and hopefully your market research will show a market available and willing to buy a product of that type. Be prepared for it to show that no one wants it.
4. Persuade those same venture capitalists to manufacture your invention, and beg them to let you keep about 5% of the profits in return for the risk they take.
5. Sit back and watch as your life savings either bear fruit in a successful launch, or sit back and watch your future go down the drain.
6. If successful, hope with all your might that the new, improved version that lies just outside your patent parameters that will inevitably launch within a year of your product doesn't catch on, at least until you've made enough money to consider the stress, risk, worry, work and effort, worth it.

Speaking of windscreens, the inventor of the windscreen wiper, had his idea STOLEN by 3 or 4 major car manufacturers.

AFAI can remember they were General Motors, Chrysler and Honda, and one other.

The biggest names in car manufacturing at the time. He eventually (many years of legal stuff) got compo - millions.

Nope - waste of time unless you're mega rich. The copiers will just change a minor detail and copy ahead. You could sue, but that takes money and time...

Think of every term it could fall under and search for it on ebay & amazon. I know a lad who has an "amazing invention" or 2 every single week, which he has supposedly done extensive patent searches on. Then I find 10 variants or the idea on sale on amazon...

OP, Are you an "ideas guy"?

I.e. I have a brilliant idea. An app that predicts next week's Lotto numbers. All I need to do is hire a "techie" to design and build it. That's just implementation; I've done the hard part (coming up with the idea).

Hi CJ,

I used to work for a law firm specialising in IP so have a bit of experience in this area.

Googling your idea would not necessarily prove things one way or another. Even if someone has patented a similar device firstly the patent may not apply in the countries where you want to market a product, secondly your invention may have sufficient distinguishing features to allow it to be patented.

Unfortunately the only way to be sure is to find a local IP law firm and have them research the issue for you. Needless to say any correspondence you have with them will be protected by legal privilege, so there's no danger they can try to exploit your ideas.

If they operate as my firm did they will bill on an hourly basis to look into already registered patents for you, if they find no immediate opposition to registration, the actual time to obtain a patent will vary depending on the country.

Strongly suggest though you only tell your Solicitors about this though - careless talk costs lives!

Hah! I actually had an idea for exactly this when I was back in college. I was fully convinced it was going to make me a millionaire.

So naturally, of course, I never bothered to pursue it and just played poker and drank Mickey Finn's instead.
