incorrect p45?

    Hello, I have a little problem.

    The factory stopped working on say the 20th of July. Instead of just finishing my employment there then, I have taken out my remaining holidays, and technically finished on say the 20th of August. I got my P45 now and it states that I finished work on the 20th of July, so now when I went to the Social Welfare office they're enquiring about what I was doing for the last month.

    Now as far as I know if I have actually taken the holidays, not just took the due holiday pay, the finishing date should be the 20th of August. Am I correct? And if so would anyone have a link to a page which proves my point? I've been trawling through citizensinformation/revenue but haven't found anything that confirms I'm right.

    Definitely get back to your employers about this. I work in payroll, and I can tell you it would be very easy to make an error like this. They will be able to reissue the P45 with the correct date on it.

    I have done this already, yet they insist they're right. That's why I want to get some proof, and then talk to them again with a paper in my hand. If they still refuse to rectify it I'll just have to get onto Revenue, but I'd rather avoid it.

    I can't really understand why it's a problem for them? Either way they would've had to pay like.

    They're right.

    You finished work on 20 July, and were paid out the holiday pay owed to you. This was not covering the period 20 July - 20 August, because you were not actually working then. It was simply an amount due, based on your outstanding leave balance. You should have gone to Welfare to sign on 21 July. Now you have to convince them that you weren't working somewhere else in the meantime.

    But I have been an employee of the company until the 20th of August, it's just that for the last month I was on holidays.

    I could have just finished in July but because I was told there may be some more work later on I decided to go on paid holiday. When that run out and there was no more work, the contract was terminated. Now according to the P45 it looks as if I finished on the 20th of July, was given whatever holiday pay I was due, and just sat at home for the month jobless already..

    Using up annual leave instead of being put on a short-term layoff and thus being allowed you to sign on for the last month wasn't the best of strategies.

    Did you submit a resignation letter? Perhaps show that to Welfare and see if that helps.

    Yep they were right. It's standard for people to be paid unused annual leave on their termination. It doesn't change your leave date.
