Damage to Car in managed apartment block

    Hi All

    Wonder can someone give me advice

    I am an apartment owner in town and over the weekend some scumbag has removed both my left and right automatic washer for headlights from the front of my car. At first I was just annoyed at the inconvenience but I have just been told the jet washers and caps (instead of just the caps) need to be replaced to pass the NCT at a cost of nearly €300 before fitting..This is not from the dealer but a general garage..

    The complex has the usually,'we are not responsible' signs but can I claim on their insurance if the cameras prove the theft happened there? Any one had something similar happen?

    How are the complex in any way liable for theft/criminal damage perpetrated by someone else? I seriously doubt you have any claim against the block's insurers.

    Does there public insurance cover theft was what I was hoping for..

    Completely understand I could be asking a stupid question here

    I doubt you need the jet washers fully functioning to pass the NCT.

    Public liability generally only covers loss incurred through negligence actions on the part of the insured, eg a drainpipe falling onto your car, you slipping on a washed floor in a common area. It's not there to compensate for every eventuality. You could be exceptionally lucky and discover that the block's insurance covers this but it's not normal, it's virtually unheard of.

    Sorry to hear that. Unfortunately it's your own responsibility, you can't claim from the OMC's insurance.

    You could claim that the car park, which is paid for through management fees I presume , did not secure your car properly. I don't know how successful you'd be, although I've heard of people winning thing kind of thing in the past since those signs mean absolutely nothing and are there to discourage claims.

    As previous poster said, if a piece of pipe etc fell on the car then that argument applies but this was theft or vandalism, unless the car park is supplied a secure (and by that I mean a premium is paid for 24 guard) then this was beyond the reasonable scope of the facility provider and no claim will succeed.

    To succeed in a claim necessary to demonstrate they failed in their duty (they have no simple duty to protect your car unless defined) or were negligent (i.e. part of the structure fell on the vehicle).

    Aren't Apartment Management fees high enough without claiming for damages to parked cars caused by idiots who may or may not live there.

    If as was stated earlier the incident was covered by CCTV, get that and try and identify who did it to go after them - if they went into the apartments then they would have to have a key or code to exit car park and so must be residents.

    Is there a similar car in the car park?

    Any cctv and leave up some notices saying parts robbed off car.

    I know my complex the excess on any claim is €2500 so even if they where liable, which they aren't, you'd just end up paying it next year in higher fees.

    OP if you have fully comp you can claim from your own policy and as it's theft it shouldn't affect your NCD

    You can't claim from the management company for the criminal acts of an unconnected third party. To use another example, you wouldn't dream of claiming against for example Dunne Stores if a pickpocket lifted your or daughter's handbag from her shopping trolley and made of with it.

    I'm afraid the issue is between you and the thief.

    sorry, I'm referring to my own private policy on my car. If i claim for theft it doesn't effect my no claims was stated earlier.

    Contact your insurer. they will only have your answer.

    Also look into breaker yards.
