Moving Eircom Pole - Eircom's cost or mine

we have to take the ditch back in from the road as part of our planning, we are knocking the current ditch and tapering it back from driveway.
Where our roadside ditch meets the neighbour boundary ditch (running at 90deg to road), there is an eircom pole at the very end of this ditch, right on the side of the road, with the ditch removed, this leaves the pole on it's own on the roadside, as the neighbours roadside ditch is also taken back.

if i report this as a safety issue, will i get stuck with moving costs?

Are your site lines and general planning conditions meet? With this pole left in place?

with the pole moved, it would improve our site line on that side, as we would remove the very end of this ditch so our roadside ditch lines up with our neighbour.

just to follow up, we have met the basic requirements of our planning conditions

What do mean improve? Is the pole within the area of ditch that was removed to achieve site lines?

If the above is the case, you'll be paying for the esb to remove/relocate the pole.

the pole is on the boundary ditch running at 90 deg to our roadside ditch,we have removed the roadside ditch which was within our planning conditions, this leaves the pole protruding out onto the road as the neighbours have also taken back there roadside ditch.

i would attach a quick sketch but not sure i how

I would be surprised if Eircom didn't charge you. It's your responsibility as you have exposed the pole. I would advise putting up bollards/protective fencing until it is sorted as you could be liable if an accident occurs in the meantime

If you had to move the ditch as part of your PP its hardly fair that you have to pay to move the pole. But when was PP ever about fairness? It does sound like a safety issue, if it was me I would report it (see below). I was told c. 2,500 by the ESB to move a pole with 4 wires, I would have thought a telecoms pole would be a lot less.

I would start by confirming to the Council that you have moved the ditch as per PP, that this has now left the pole exposed and a hazard as would have been foreseen by the planner, and ask them to advise what steps they are taking to rectify. Worth a shot.

Or, you could ask your architect for advice?;)

planning = fairness = ideal world
from what I hear, Eircom are extremely difficult to work with on this type of issue and standard protocol is to hit you with costs....

you caused the problem, you pay.

    Dam right !

you wanted to build = you got planning = planning told you to build safely = you moved ditch exposing pole - why are you blaming anyone other than yourself for the hassle/cost of moving this pole?

    easy tiger

i have in no way exposed the pole
the pole is an exposed as the day it was put in place.
now that i have moved the ditch on my side of it, the pole now isolated in it's position...

    as per attached sketch

its very simple, if the pole restricts you from achieving the necessary sight lines as per planning conditions and documents, you must pay to move it.

if it doesnt restrict your sight line, it doesnt have to move, as long as its still structurally safe.

Are you connected to this pole? Have you thought about connection yet? This may be resolved at connection time.

Get some one with a big tractor and dump trailer to "accidentally "back into it , their not that strong when hit and break fairly easily , report immediately and say whoever hit it was gone within a few minutes , then ask the guy who comes out to fix it to move it back to where you want it , job done

Outrageous suggestion...but also the most likely to get a result :D

So you haven't contacted them yet, you are yet to be connected for phone and already hatching dastardly plans for answer B when you don't know answer A...?
