    Hi just wondering how would someone find out if they have guardianship of their child?

    If the father is married to mother at time of birth, he has it, otherwise he has to apply, did he/you apply ?

    They were never a couple or married. He can't remember if he applied for it when the child was born. He doesn't want to ask the mother in case it cause trouble. So I'm wondering if there a way to find out with asking her? Ie: ring some state office etc? I no if he applies for it now she will have to give consent.

    While the mother's views are taken into account, the fact that she does not consent to the guardianship application does not automatically mean that the court will refuse the order sought by the father. Instead, the court will decide what is in the best interest of the child.

    He should know if he applied for it and was successful
