    Hi everyone just some advice if anyone can help me.
    Looking at my house from the road there is a drain and a ditch to the right. The ditch has mature trees through it and the drain is on my side. On the left side of the house the ditch is my side and the drain the other side. On the left the ditch doesn't have many mature trees but has years off growth (whith thorn, wild rose bushes...)
    Now on the left side there is a field next door and today a tracks machine is starting to clear the land and now I have big gaping holes in the ditch.
    My question is.....does the person next door have to replace the ditch?

    Thanks a million for that. I'm still a little unsure as to who owns what.
    The guy that has removed the ditch offered to plant shrubs and possibly put up a paneled fence. A paneled fence would look very wrong in the country between to sites (i think) and the shrubs if only 5 inch to a foot long could take 5 to 10 years to mature. Does he own these if he plants and erects them?

    Yes he owns them but you need to establish the site boundary.
    The legislation is clear on the need to reinstate so a 10 year wait is clearly not on
