    If a person bought a used car from a dealer 15 months ago. Paid for it by cheque from his credit union, and discovered 15 months after buying it that the car had been written off previously as a result of a car crash and repaired.

    1. If the dealer never disclosed this information when the car was being sold, would the current owner have any come back with the dealer whom he bought it from?

    2. Would it have any bearing on the credit union who would be the true owners of the car?

    Can you prove that the dealer knew it had been crashed and repaired?

    Comeback on what basis? Are you suggesting the dealer knew the car was crash repaired? Did the price you paid reflect the diminished value of a crash repaired car?

    You need to check you loan terms but the Credit Union is unlikely to be the true owner of the car. If you just borrowed money then the car is probably yours. http://www.creditunion.ie/whatweoffer/loans/carloans/

    Surely they have an onus of responsibility to ensure the car has not been written off before providing it to someone.

    Not really. "Written off" doesn't necessarily mean a car is dangerous. An insurer will often write a car off if the claim exceeds a certain % of the value of the car. Some "written off" cars can and are repaired. Insurers will usually require a motor engineer to certify the car's safety before providing cover following a major repair.

    Is the car mechanically and structurally sound at the moment? If so, and you paid what you considered to be a fair price at that time, then you don't have a problem.

    As said above a car can be classed as an insurance write off if the cost of repair exceeds i think 50% of the value of the car. And also this can depend on where the car was brought to have the repairs carried out. I have had a car years ago which was crashed into and i brought to get a quote for repair and the garage (which was the insurers approved garage) priced it at €2,000. The car was only valued at €2,500 so the insurance classed it as a write off. They paid me the €2,500 for the value, i also bought the car back for €500 from them and had it repaired at another garage for €400 which left me with the car back to how it was and me with €1,600 in my pocket! It makes no sense but thats how the insurance works so your car could of had very little damage. Mabey it could of even been keyed all over and needed a full respray with no actual panel damage, But how did you find out about it being written off before? Was it way of reg check or has a mechanic seen where it was damaged and repaired?

    I hope your insurance premium didn't jump by €1,600 after all that :)

    I should of mentioned that i was hit by another driver and it was their insurance that paid out ;)
