Missed Equality Tribunal Appeal Date

    I have missed this by a few days. Does anybody know if there is any point in submitting anything anyway.Really stupid of me but I got distracted by a mental health review I was having at that period in addition to counselling at Pieta house.

    Sorry you missed your appeal date. I had a similar experience with another agency. The following process should work. Write to them (not phone) saying for health reasons you were unable to respond in full by the XXX date and you are now in a position to do so. Ask for an extenstion of appeal date specify a date in the next ten days and say you will have a full response and a GPs letter confirming you were receiving medical attention and in no fit state to make a decision or give the matter the consideration it deserved around the appeal date. Pieta House will also give you a letter saying you have been attendiong them from XXX date to XXX date. Pieta wontr say more than that. You will still need the GP note but once your GP note goes in you with your comments on your appeal you oshould be ok, oh and send by registered post so appeals cant say we didn't get your letter.     There are certain statutory appeals which cannot be extended, including some in employment law.

    From memory, you can extend an equality appeal (I have six months in my head) but I'd get going straight away.

    I am assuming that you know that the appeal is to the Labour Court. If your case has been heard in the ET, they have no further role in the matter.
