Garda notice

    I got stopes at a roadside checkpoint the morning after a night out and failed roadside test was taken to station and blew 44 was told be 6 month ban and fixed notice fine . Received notice but paid it a day late and was returned phoned fine office and was told I would get a 56 day notice that was 4 months ago and no notice or no summons what is happening here sold my car thinking I was being banned and don't want to buy car again incase I do

    Ring the fines office and ask them the status of your notice. After the 56 day period has expired a summons will automatically be generated. It might not have been served on you just yet in which case you will have a court date at some stage in the future. The only people who will be able to give you that information are below:

    They have 6 months to issue a summons, then it will float around an office until a week before the court case and a Garda will arrive at your door with it, every feckin time. I'd ring and find out as they haven't just forgotten. Get legal representation too, judges look badly on self-representation.

    Yea I know but it says online that it fully automated and summons is issued right after 56 days has passed . Do this still fall in the bracket they only have 6 months from date of crime to apply for summons if so next week is the 6 months

    It is 6 months from the date of alleged offence. This 6 months limitation concerns the application of a summons only. A court date can be up 3 to 4 months after the 6 months is up

    The only thing it says online it's automated and and after 56 days it automatically posts out a court date the 56 days is past over 3 months ago so why no sumons plus never got a 56 day notice either it's annoying as sold my car and if it was done right I would be back on road in 2 weeks
