Hi, my daughter has been working for the past 9 weeks and has been paying emergency tax up until last week, she had been in touch with revenue about claiming her emergency tax back, twice they sent all details to her employer. Anyway her employee has informed her today that she will give her her emergency tax back week by week (she's working full time). Can her employer do this or should she have to give it to her in a lump sum?

It should be given back in a lump sum. Sounds like the employer is dicking her around

This happened me too, I paid less tax per month until what I was owed was back to me, but it was the tax office that decided to do it that way not my employer?

Ok, Thanks for the reply . I will get her to check with revenue tomorrow, but I think it's her boss who has decided to do it this way. Did you get all your tax back ?

Yes I did, my wages were just higher than normal for a while (paid monthly). It is a pain, I was hoping to get it in a lump sum too. I am starting a new job and have phoned the revenue already as I don't want the same hassle again!

Hi, sorry to be a pain, but did the revenue inform you by letter that they were doing this? She is actually owed nearly 1000 euro, but grr boss said it's a lot of money so she will give get extra each week, I think she's pulling a fast one !

No not by letter, just over the phone. If she called the revenue they should be able to tell her if it's their decision or the employer. Not being a pain at all hope it helps, it's a lot of money.

an employer is allowed to give it back over a period of weeks IF it would affect their cash flow. having an unexpected payout of 1000e in one week's wages could be huge effect on cashflow

Yes. The business doesn't have to compromise their cash flow in anyway.

Hi, yes I checked with revenue this morning, she can give it back week to week or else my daughter can apply to revenue herself at the end of the year, thanks for reply

In most companies it would be more of a balance the books kind of thing .

So if there were 10 employees paying €50 a week in tax , and your daughter was due refund of €500 , then one would balance out against the other .

But I suppose if the returns are only been made monthly , it could affect cash-flow , if it was near 30 days away from return date .

Where companies offset VAT refunds against their p35 return they often never have to pay money to revenue, So a 1000e emergency tax refund would be too much to process in one go.
