Driving Ban

    Hi All
    This could have been asked before but I searched and found nowt so here goes.

    I got a 5 year driving ban in Nov 2013 as the result of an accident I was involved in. The case was heard in the Circuit Court. I was charged with Dangerous Driving but pleaded guilty to Careless Driving.

    Up until this point I had a completely clean driving licence for over 20 years. I never even got stopped or had any haasle from the Gardai or PSNI

    Its a right pain at times not being able to drive - I am not able to ake the kids away for an outing for example - Wife has to drive everywhere :mad:

    Now to my 3 questions
    How long do I have to serve before I can appeal ? Ive got figures from 3/4 to 1/2 the time

    If and when I appeal does it go back to the Circuit Court or will it be the District Court ?

    If I appeal and get my books back will I have to through teh whole test N plates etc etc again ?

    First off it's not an appeal it's a restoration application the time to appeal to the Court of Criminal appeal is well past.

    In answer the application for early restoration is made to the court that imposed the ban or in the case of a case that was appealed the appeal court but only if that court varried the ban in any way.

    The application can be made once the ban exceeds 2 years and (this is important) the ban after early restoration must be at least 2 years served, in simple terms can only work on bans of more than 3 years.

    The application can be made to court once at least 1/2 ban has been served but the court can only restore from a point on or after 2/3.
