JSA to Illness Benefit

    Quick query

    I was recently diagnosed with post natal depression.
    I have just today received my letter back from the illness department. Stating that I'm entitled to € 114.30.
    While I was on jsa (moving from jsa to illness) I was getting 186.20.
    so I'm taking a hit of 72 euro a week.

    The letter states that I may qualify for SWA if my personal rate is less than 188 (as per picture attached)
    My question is.. will the CWO give me SWA To bring me back up. Or is it at their discretion? I've tried phoning them. No answer.

    Background is 2 kids. Partner on jsa.

    The CWO will means test you for SWA and if your eligible should pay you the balance to bring you up to €186

    You can have up to 5k in savings but anything over that will be regarded as means.

    As your partner is on JSA also the CWO would at most bring you up to the max family rate less €2 so you would be topped up to get €184.60. The easier option might be for your partner to claim for the full family on their claim and you continue to get DB certs to keep your contributions up to date. Make an application to your SW office for the change to your partners claim and you request DB to stop payment on the claim but the keep the claim open for credits only.
