Waste treatment system issue

    Hi,

    Just looking for opinions as to whether I should speak to a solicitor.

    We've been living in our house for eleven years. We've had ongoing (minor) issues with our waster treatment system, starting with finding out in 2006 that it hadn't been commissioned before we moved in and started using it. We have under our employ a company who does an annual inspection and any work that needs to be done. During this years inspection, in January, it was noted that our tank had a notable bulge, and there was most likely a problem with the percolation area as water was at a high level in the percolation box. We had the tank emptied and desludged in March and within the two months since the inspection the bulge has increased greatly in size.
    Our air blower pump stopped working last week so we had an engineer out on Tuesday to fix it. He recommended that a full inspection of the tank was necessary to determine the damage the bulge was causing. Due to the high water level in the tank it is difficult to see if there is a big crack but at the top you can see small cracks beginning to appear around the pipes. We also need to get a separate engineer out to inspect our percolation area.
    The full tank inspection is going to entail having the tank re-emptied, and a two man crew from the aforementioned company to carry out the inspection.

    What I would like to know is do we have any recourse with the builder? It has been stated repeatedly by numerous engineers that the system was installed incorrectly, and in addition to this the tank itself was modified - the inlet pipe was moved leaving a badly covered hole. I was advised the bulge is being caused by pressure being exerted on the tank which shouldn't be happening if the surrounding concrete was properly in place.

    So, we may find out that the percolation area isn't fit for purpose and we'll have to have that resolved before we even move onto finding out how badly the tank may be damaged. This is obviously going to cost a lot of money, which we do not have to spare.
