8 months on & still waiting on the guards to take my statement

    Well I a nice big van came through the building I was sitting in & hit me from behind I don't remember what happend but I the guy that was next to me said that all he seen was me been thrown throug the air at lightening speed he said I hit the wall so hard & fast that it spun me around & I was facing outwards when I dropped to the floor, was in hospital for 9 days and I'm still in constant pain & on a walking stick had to give up colleg & have nightmares can't sleep & have 6 to 7 headaches a day every day lasting from any where from 30 seconds to 10mins & also been diagnosed with PTSD but the worse thing of it all is I'm still waiting on the guards to take my statement many a time I rang the station looking for said guard to be told he's off duty or not in I left my contact deatails to say " please have him contact me as soon as he can thank you but still no call back what should I do ????

    Go to a solicitor, have him/her draft up a statement and give it to you to take down to the station to sign in front of a Garda.

    Why do you need to give a statement? There's probably plenty of evidence without it.
    Especially if you can't remember or don't know what happened, i'm not sure how much benefit your statement could be.

    But not being able to make a useful a statement won't affect entitlement to compensation.

    That's what I said , I was talking to the man next to me then blank next thing I'm on the ground covered in rubble ??? I told them I don't remember what happened but still have have a statement taken ???

    People make statements to the guards so that a criminal prosecution will be brought against whoever caused the accident, for careless/dangerous driving.

    Yes I'm well aware of that.
    But in this case it doesn't appear that the guards are that interested in chasing her for a statement. And that's probably because the material evidence is overwhelming on its own and the statement of a person didn't see what happened, and can't remember anyway doesn't add much weight to the prosecution.

    That might be the case. It could also be that the guards haven't pursued the matter.

    Write to the Garda's superintendent, give full details of the date & time & place of the accident. Point out that you were seriously injured and haven't been contacted and are wondering if there is any kind of investigation going on.

    But you really need to talk to a solicitor to get a civil claim going. That solicitor will get in touch with the Gardai to see what's happening.

    is there a need for a statement? Are they planning on prosecuting anyone?
