legal eagle query

    Hi everyone,
    I'll try to make this long story short.my husband has rights to commonage that was given to his by his grand aunt, he is entitled to 2 sevenths of this mountain. When he applied for EU payments he was refused his 2 sevenths as somebody else was claiming it so they reckon my husband was falsely claiming. the dept of agric said to sort it out between ourselves.
    at the meeting there were 8 people saying they had a right going back generations.
    as we are not from the area we don't know the history of it but 1 fella said that s family divided their share between children so they should really only get 1/14, nobody admitted this so just to get our payments we had to sign a paper just to claim 1/8 instead of 2/7's. this was very fustrating as we know who is wronly claiming but cant prove it.
    we were advised that we can get the services of a legal eagle for free, is this the case. if we do bring a case before the courts how long would this take,
    unfortunatley we wont get this sorted before the end of april dealine, so the fraudster can get his money till 2020

    Definitely go with a legal eagle. Make sure he isn't an ill eagle.

    Unfortunately you probably wont get legal aid or a solicitor to work for free.id suggest you work out how much the alleged right is worth to you and that will inform your decision on whether or not to pay for a solicitor.

    Well at present i will be getting 2000 per year, but i should be getting about 3800. would it pay me to get a soliciter, could they even be able to prove the other guy hasnt any right. my husband really shud have gone about this last year as whatever we enter for 2015 is locked in for the next 5 years. the deadline is end of April

    Its up to you to decide whether its worth it. Ring around a few local solicitors and get a few quotes

    The chap that has been claiming on "your"land could have a right to adverse posession.the longer he has been using it the more right they will have.

    No.

    I doubt that any private solicitor would carry out this work for nothing and I doubt that civil legal aid would cover it, even if you met the financial criteria.
