Lenth of time to get High Court appeal.

    Possession order granted in circuit court against a friend recently for principal private residence. If he lodges an appeal how long would it take to get to the high court for a hearing?

    It would depend on which Circuit Court. The High Court travels to certain towns to hear Circuit Court appeals in civil cases and the backlog will be different for each circuit court. I won't be able to provide an answer but if you say which circuit court, someone practising there or who knows someone who does might be able to give an estimate.

    Your appeal will probably be heard in the High Court in Kilkenny. There are two sittings listed in 2015 for Circuit Court appeals: March 16-20 and Nov 30 - Dec 4. The Kilkenny sitting hears appeals from the Circuit Courts in Carlow, Kilkenny, Laois, Tipperary, Waterford & Wexford.

    So the earliest date you're going to get is Nov 30 - Dec 4 next.

    Thanks again for the reply. There was a six month hold put on the possession order in the circuit court. If the appeal was rejected in the High Court would the six months hold begin after the High Court appeal or would the time between now and the appeal sitting count as part of the six months?
