    Hi,

    I have a friend who works in a restaurant. She starts work at 6:30am and some days goes home at 9am and returns at noon until 6:30 or 7pm. She has a later start on Sunday (8:00am). Due to staffing difficulties she has been working 7 days for the past two months. She hasn't kicked up about it because she likes (and values) her job but I do see it wearing her out. I understand that the extra money is handy but if these hours are mutually acceptable between employer and employee does that make it legal?

    Does she get any of her entitled breaks? Have a look at the Organisation of Working Time Act 1997. There's quite an amount of info on Working Time on the Citizens Information site. Educate yourself and your friend before making any approach to the employer. If the employer has staffing difficulties, he's unlikely to sack her. Then again , if he really does have those difficulties, there may be a reason for it - he might have a record of working his staff so hard they just leave.
