did this need a fresh thread?

There are 2 threads on the go on after hours and in television. Both titled 'Jeremy Clarckson suspended'

He is no longer suspended and as such I thought a new thread was warranted. However, it will be for the mods to decide if they merge or not.

Fair play to the BBC. They are dead right. Nobody has the right to think that they can verbally and/or physically abuse a colleague and expect to get away with it. Had the Beeb not sacked him they would have left themselves wide open to litigation. Good riddance to the bully.

He wasn't sacked though, he had one week left on his contract and now there won't be a new contract. See them all in ITV/C4 in the near future.

    Just seen James May interviewed.

He appears to strongly imply that it was the original 3 man team or a completely new format of top gear.

    He looked rather peed off

Hopefully another channel picks up the show and the three presenters.

Saw someone say that they wouldn't be surprised if it got taken on by Netflix would love to see that myself.

Would be huge if Netflix picked up the three lads for a new type of show

I imagine they have a noncompete clause in their contract. They may have to wait a few years before they can work again

Top Gear has a massive budget... Not sure it would be the same show on any other channel. Those specials must cost millions to make.

Noncompetes are common in America but they break all sorts of EU laws. They do exist over here but like most clauses in contracts, if you contest them, you nearly always win.

    That wont stop them working.

Which is just a polite way of saying hes been sacked. When your contract has been "renewed" every year for a decade and then it suddenly isn't, you've been fired.

Well under Irish employment law, someone on a repeat yearly contract can be seen by revenue to be full time employees (some tests there like sole source of income, working under direction, not paid by job lot etc...). Don't know if these apply in the UK, but he may be entitled to redundancy payment !!
Also isn't there some legislation saying you can't have a contract that prohibits you from taking up work in a competitors business if that deprives you of an income.

We've no idea if that stipulation is in his contract or indeed how enforceable it is (Non compete)

As they are out of contract surely there would be no issue here with a non compete clause. They are now free agents no?

Of course they are free agents. The BBC owns a programme title, an intellectual property it can licence but that's all.

If they stick together Clarkson, Wilman, May and Hammond can do pretty much as they please - so if they play it cool something quite like Top Gear can be made by Netflix or Amazon Prime and if they are clever they will make sure that the programme is made available to FTA tv after say 6 months.

  • Registered Users, Registered Users 2 Posts: 1,452 ✭✭✭ads20101

Wherever they go, they will have to find a company (like the Beeb) that isn't overly governed by the needs of advertisers.

Think of the critical reviews they do (on a rather regular basis).

Netflix, Amazon prime, hbo, are 3 I could think of just off the top of my head.

Netflix would be onto a serious winner by grabbing them as quickly as they could. Equally, unlike many shows they have an instant ready made global audience.

I fell out of love with TG several years ago, from thinking it was much see TV.

I got sick of the show that basically became a vehicle for Jeremy Clarkson. The challenges/specials were worse than WWF they were so fake.

Eventually it was just a comedy that had a car theme.

While it was so successful it was never going to change, so hopefully it will become somewhat car centric again.

The biggest surprise about this is that JC (:pac:) is only 54. He looks closer to 64.

+1 let's get top gear back. Back to the way it was pre 2005. A quality car programme for those interested in cars.

Clarkson in particular made a jack ass of himself in the last ten years and brought james may who is a motoring journalist in his own right along with him.

Even the guys who made jackass knew when the game was up. Goodmove by the bbc.

Are the other two lads contracts not being renewed either? if not, how would they be able to join Clarkson on his next offensive project?

There is no reason why JM & RH's contracts won't be renewed.

However, in the current climate, I'll be surprised if they do.

I think top gear is about to have a gear change.

Yeah - I had time for "Captain Slow" (how he allowed himself to become a mockery), but his integrity was sold as well. For many millions I might add, but sold nonetheless.

James May's Twitter bio says "Former TV presenter only remembered for saying 'Oh cock'. Or was that the other bloke?"

    So I don't think it's being renewed.

Oh no, who is going to take the place of the trio in the contrived challenges now. Now some one can go back to reviewing cars instead of the format that makes the stories in professional wrestling seem less staged. I expect he will be running for office in the BNP soon.

Who the **** want a review of tin boxes?

I think this is a very smart move. Fact is that Top Gear has gone stale anyway and at some point in the near future the BBC would have had decisions to make regarding the direction of the show. Sure they could have carried on for years with the same tired old format, but far better that they act now to reinvent the show.

Taking the chance to get rid of Clarkson is step one, and they could still fail at step two which is getting the right replacements and new format in, but I think it is the right decision to take.

It’s a sad day indeed when a man can’t express his dissatisfaction with catering arrangements by verbally abusing a junior colleague in public for twenty minutes before physically assaulting him.

Personally I’m hoping that every one of the million people that petitioned to keep him in a job, is punched in the face and verbally abused by a senior colleague this evening; hopefully for something utterly trivial. I then hope that they reflect on their stupidity.

  • Closed Accounts Posts: 876 ✭✭✭Euphoria Intensifies

Can people really see Netflix taking them on? Top Gear costs absolute millions to make and I don't know if they'd have the money for it... Although it is quite popular outside the UK/Ireland so maybe they would do it because of the global audience. Still don't think it's likely though. I wouldn't be surprised to see Sky offer them a deal though.

I can't believe people think that Clarkson shouldn't have been sacked. I don't care if you work in a shop or in television, verbal and physical abuse of a colleague is 100% grounds for dismissal.

Netflix have enough money to make House of Cards an episode of which costs over 6 million dollars. Clarkson and Co would be a big selling point for NF or Amazon Prime.

The full statement, sorry if already posted
"On 9 March 2015, Jeremy Clarkson reported to BBC management that he had been involved in a physical and verbal incident with Oisin Tymon, the producer of Top Gear, at the Simonstone Hall Hotel, North Yorkshire, whilst working on location. The incident had occurred on 4 March 2015 and Jeremy Clarkson was suspended on 10 March, pending investigation.

I was asked to undertake an investigation to establish the facts of what occurred. In conducting my investigation, in line with the BBC’s usual practice, I interviewed a number of witnesses and others connected with the incident. Accounts were agreed, based on my interviews, with each participant.

Having conducted these interviews and considered the evidence presented, I conclude the following: on 4 March 2015 Oisin Tymon was subject to an unprovoked physical and verbal attack by Jeremy Clarkson. During the physical attack Oisin Tymon was struck, resulting in swelling and bleeding to his lip. The verbal abuse was sustained over a longer period, both at the time of the physical attack and subsequently.

Specific facts I have found as part of my investigation are as follows:
    • Earlier on 4 March, studio recording of Top Gear had taken place in Surrey and the presenters had travelled that same evening to the location shoot in North Yorkshire
    • the incident occurred on a patio area of the Simonstone Hall Hotel, where Oisin Tymon was working on location for Top Gear
    • The physical attack lasted around 30 seconds and was halted by the intervention of a witness;
    • It is the case that Oisin Tymon offered no retaliation;
    • The verbal abuse was directed at Oisin Tymon on more than one occasion – both during the attack and subsequently inside the hotel – and contained the strongest expletives and threats to sack him. The abuse was at such volume as to be heard in the dining room, and the shouting was audible in a hotel bedroom derogatory and abusive language, relating to Oisin Tymon and other members of the Top Gear team, continued to be used by Jeremy Clarkson inside the hotel, in the presence of others, for a sustained period of time;
    • It is clear that Oisin Tymon was shocked and distressed by the incident, and believed that he had lost his job following the attack, I understand that Oisin Tymon drove to a nearby A&E department for examination; over the subsequent days, Jeremy Clarkson made a number of attempts to apologise to Oisin Tymon by way of text, email and in person; and
    • It is the case that Jeremy Clarkson reported the incident to BBC management.

It was not disputed by Jeremy Clarkson or any witness that Oisin Tymon was the victim of an unprovoked physical and verbal attack. It is also clear to me that Oisin Tymon is an important creative member of the Top Gear team who is well-valued and respected. He has suffered significant personal distress as a result of this incident, through no fault of his own."

"It is with great regret that I have told Jeremy Clarkson today that the BBC will not be renewing his contract. It is not a decision I have taken lightly. I have done so only after a very careful consideration of the facts and after personally meeting both Jeremy and Oisin Tymon.

"I am grateful to Ken MacQuarrie for the thorough way he has conducted an investigation of the incident on 4 March. Given the obvious and very genuine public interest in this I am publishing the findings of his report. I take no pleasure in doing so. I am only making them public so people can better understand the background. I know how popular the programme is and I also know that this decision will divide opinion. The main facts are not disputed by those involved.

"I want to make three points.

"First – The BBC is a broad church. Our strength in many ways lies in that diversity. We need distinctive and different voices but they cannot come at any price. Common to all at the BBC have to be standards of decency and respect. I cannot condone what has happened on this occasion. A member of staff – who is a completely innocent party – took himself to Accident and Emergency after a physical altercation accompanied by sustained and prolonged verbal abuse of an extreme nature. For me a line has been crossed. There cannot be one rule for one and one rule for another dictated by either rank, or public relations and commercial considerations.

"Second – This has obviously been difficult for everyone involved but in particular for Oisin. I want to make clear that no blame attaches to him for this incident. He has behaved with huge integrity throughout. As a senior producer at the BBC he will continue to have an important role within the organisation in the future.

"Third – Obviously none of us wanted to find ourselves in this position. This decision should in no way detract from the extraordinary contribution that Jeremy Clarkson has made to the BBC. I have always personally been a great fan of his work and Top Gear. Jeremy is a huge talent. He may be leaving the BBC but I am sure he will continue to entertain, challenge and amuse audiences for many years to come.

"The BBC must now look to renew Top Gear for 2016. This will be a big challenge and there is no point in pretending otherwise. I have asked Kim Shillinglaw to look at how best we might take this forward over the coming months. I have also asked her to look at how we put out the last programmes in the current series."

I think whats bolded is whats most important. Bravo BBC

Wolf Hall is due a sequel. JC can play Henry VIII (fat version) as he has Mark Rylance beheaded for dopey acting and conning him into marrying a German horse (50% observational / 50% historic for the highbrows).
Anyone complaining of spoilers needs to watch less TV.
