House Completion exempt from Building Control Regulations

    I commenced a self-build a number of years ago and progressed it to first fixture stage internally ( i.e. first stage wiring and plumbing completed) in 2010 and then left it to undertake other projects. Externally, ESB & water connection have been paid for and brought on- site, but sewer has not been dug and connected.

    Am now hoping to complete it & my question is, am I exempt from appointing a CA as the build commenced prior to new Building Control regulations being introduced.

    I would think that your are exempt.
    Is your planning still live though?

    Provided you are still within the length of your original planning permission (and you lodged a commencement notice correctly at the time) you should not have to appoint an AC now.

    Technically if your planning has lapsed you should get a new planning permission for the external environmental works (sewers, effluent treatment system, etc.). That's not to say that everyone in your situation actually does this - BUT it is the correct and only legal way to do it.

    There are plenty of people out there that have gotten the idea in their head that if you whack up the main structure to wall plate level (even this level is not cut and dried) you can leave it sitting there for as long as you want and finish everything else later. The planning laws are more nuanced than that.

    Having said all of this - your question was about the BC(A)R and if you don't need a new planning permission you don't need an Assigned Certifier.
