Another Insurance Claim...car not "fit"

    Hey

    Had a tip with the car last week where driving down driveway (hill) car lost control and hit edge of pillar.

    Anyhow, I rang today to find out what was taking so long (4 business days at garage) and was told still waiting assessors report...and reason was that there was a question around tyres been bald. Bit of a WTF moment. Statement was that not sure what implications are and will be dependent on report.

    Now, to be honest I don't know for 100% sure if they are or not but looked ok on the day.

    So say worst case and they declare the tyres bald are they entailed to say no money as under "Duty Of Care" section of policy "must keep your car in a roadworthy condition"?

    Is it worth getting solicitor involved (or is this a waste of time and more money down drain)? Should I get a separate assessment done (Anyone know somebody in Limerick that does this)?

    Is there verbiage I should use when talking to them?

    Was Tuesday morning last week...road/hill was covered in snow/ice...i was crawling

    I don't want to sound discouraging, but skid on a snow on bald tyres seems like more than perfect reason for insurer to refuse to pay.
    Bald tyres could have been direct reason for skid.

    It could be different if bald tyres had no connection with accident - f.e. you reversed into the pillar because you didn't see it. In that case, you woulnd't see it no matter if you had new tyres or bald tyres. No direct connection so probably good solicitor could help.
    In that case where you skidded with bald tyres, I personally wouldn't even bother trying.
