Someone reversed into me

    Hoping someone can help here.
Last night I was leaving Lidl. I saw a car put on his reverse lights as I was approaching and I beeped...twice...but he kept coming. I stopped but he still manage to clip my front wing.

Straight away he got out, apologised and gave me his details, promising that he'd call me today. He appeared to be genuine. I was tired. It's not a big dent etc so I took his reg and details and said fine.

I got back into my car and continued on, when to my surprise I saw an arrow identifying that I was going the wrong way and heading for the main entrance. I pulled in to turn and go back the correct way. In doing so the driver of the other car continued his manoeuvre and went out the same wrong way.

So, today he rings, completely on the defensive, saying that the accident was my fault that I was going the wrong way. I acknowledged that yes when I got back into my car I had realised this but pulled in to turn and saw him doing the same thing. He said that was irrelevant that my careless driving had caused the accident. I said no that I had beeped as soon as I saw his breaks lights come on. He acknowledged that he heard a beep but was concentrating on the girl in the car beside him to see if she was going to go out first, when she wasn't he moved. I asked if he didn't look both ways he said...no as I didn't expect anyone to come from the left. I asked why then had he gone the wrong way. When he reversed to turn right did he still not look to the left. He got a little nasty then.

He said that the insurers would see his side. That I was clearly in the wrong. I suggested that if he wanted to be like that we could get have the CCTV requested and that that would also show that he shouldn't have reversed anyway as there was a white van coming from the right. Had he not hit me, he could have hit him.

He got quite frustrated but said he would be lodging a report to his insurers. I can't until Monday as I'm in a fleet car. We didn't call the Gardai last night as he had admitted liability exclusively.

Can you help? What are there rules?

The rules are. You start a new thread not digging up an old one.

From an insurance point of view, you sound screwed. I was on the wrong end of a similar situation.

As other poster says start your own new thread.

    Quite possible 50/50

    Both of you were wrong.

Suggest if damage isn't bad you both agree to settle your own and arrange to exchange a written letter and sign that you both agree.

There are times when insurance is better left out as premiums will go up.

On a main road if someone stops and you go into them you're in the wrong. Is the 'hitter' not always in the wrong?

    Who hit who?
    1) Were you stopped and he reversed into you?
    2) Was he stopped and you bumped into him?
    3) Were ye both moving when ye bumped?

His defense of "I didn't expect anyone to come from the left" is idiotic really. Im sure not expecting things to happen is the root cause of alot of accidents. Taking the one way system of a carpark out of the equation (and assuming option 1 above), he hit you. He should be liable. Whether an insurance company will see it that way or not is another story.

I would expect the worst, and assume an insurance company will side with idiots who blindly reverse into objects, rather than idiots who drive the wrong way in car parks. (no offense)

    He hit me.
I stopped when I saw he wasn't stopping after my beeps, but it was too late he came out and hit me.

I genuinely hadn't realised I was on the wrong way...I know that's not an excuse....when I was moving from my space I could have reversed or drive forward through an empty space. I went forward. There were no markings at this point for which direction I was supposed to go.

As soon as I saw the marking I turned, though this was after the incident.

You warned him and stopped, his continued on, his fault. You took every care to prevent the accident.

One would think/hope but I guess his his word v's mine now :( He could now say I didn't beep?

Funny how last night he acknowledge 100% that he was wrong....he wasn't concentrating etc, but today he changed. He didn't even take my reg or anything.

I guess I'll just have to see how it plays out. I'd be less stressed if it was my own car but it's a fleet car...hate going to my boss about it.

Get the cctv from Lidl. It is of little relevance that you were driving the wrong way in the car park if you were stationary when his vehicle struck yours. The cctv wont be there for long, so make sure it is saved at the very least.

Id agree here too. I just wouldnt want to have anyone thinking thats how insurance would see it. Years ago I had someone sweep across 3 lanes (roadside parking space, across lane 1 and into land 2 and hit my front passenger side of the car. Insurance claimed I hit her from behind.

They're a strange bunch at logic

Get yours fixed boss will never know..

I would contact your man once and say look fix your own I'll fix mine if as you say its not bad.

There are guys out there that if its just a small dent they can pull it back out and like new.

If you know for sure you were right then tell him you are putting in claim.

That would look very suspect if the other guy then claims. You can't just damage a fleet car and have the dent pulled. Covering it up could cost the new OP his/her job.

    Thanks all for your comments.
I agree with goz83 it would be more than my jobs worth to conceal.

I've sent an email to Lidl asking as goz83 suggested that they save the clip, in the event that the guy stays nasty, as I know what it will show.

Lidl is a private car park, do their one way lanes have any legal standing?

Either way he hit you, what if you were a person, what excuse would he have

  • Registered Users, Registered Users 2 Posts: 3,282 ✭✭✭Bandara

Lidl will not give you or allow you to view the cctv

Neither will they save the cctv of the incident because you emailed them

You need to go to the Garda and have them request the footage.

Most CCTV systems last approx 28 days, after that they are overwritten.

Go to the police station tomorrow
