giving notice

    Quick one, if some looks to give notice in thier probation period, must they be informed the probation period is over for the 4 week rule to apply

    It all depends on the contract of employment.

    Only that will give you the definitive answer.

    Thats the thing. Contract says one week notice during probation.
    probation period is 6 months following review, which can be extended.
    no review was done, so can the 4 week rule still apply

    If the person is there less than 6 months then it's 1 week.

    If they are longer than 6 months then the probation is finished and it is 4 weeks if that is what the contract says. They do not have to sit the employee down and do a review at the end of the probation. They could claim that the management reviewed the performance and did not extend the probation.

    From my experience, companies may allow a shorter notice period than contracted when they can do so operationally. Best to just ask them.
