No transfer of entitlements without land?

    Hello Folks,

    the transfer of entitlement form 2015 is not yet available to the public but I have been waiting and had one sent to me now as its just available to the government.
    I need to transfer entitlements to my siblings as they were left by my late father to them. They do not have land. Up to now the form was straight forward and you had to note the quantity and value on the transfer form. However this year there is no section for transfer of entitlements on their own. There is only inheritance or transfer of holding with entitlements? This seams very strange.

    Can anyone shed any light on this please?

    I think ur siblings need land i.e. one hectare for each entitlement transfered

    thanks merryberry,

    they do but if you compare last years form with this years its very different. Last year there was the possibility to inherit entitlements without land but of course these needed to be passed on or land purchased before they could be used. But in this years form there is no section for inheriting entitlements in any way shape or form. Only inheriting land with entitlements.

    I'm afraid your siblings will lose any entitlements that your father left them unless they can rent the same number of hectares as entitlements they have before May 15th.

    Everybody's existing entitlements were extinguished on New Years eve 2014. What every farmer then had in Jan 15 was a entitlement allocation right & reference value for the new scheme based on their previous entitlements that they had and the amount of land they have..

    Once a farmer applies the the new BPS scheme before May 15 they will activate their allocation right & reference value.

    In short if you have no land for the entitlements you will loose them and they will return to the National Reserve.

    Does that mean ,if you let out your farm this year for the first time ,you lose your entitlements??

    I believe you can also let the entitlements with the farm. So where you are letting the entire farm, then the entitlements would be let with it.

    If you are leasing all or nearly all you are better leasing entitlements with the land through a private contract clause, this way you wont loose entitlements.

    If you are leasing part of your farm and intend on farming the rest, you can do as above or you can consolidate (stack) entitlements on the area your farming. By doing this your increasing the value of your remaining entitlements and could be liable for reduction of value if over the national average. But you can only do this if the leasee does not intend on applying to the national reserve for new entitlements. You cant create a new holding for new entitlements off the national reserve.

    Have any of you a link explaining the transfer of entitlements to an heir who qualifies as a new entrant ?. Will that heir get my exact entitlements or benefit from the National reserve as a new entrant ?.
