Entitlements question

    Quick question for ye all, home farm is going to be transferred in the coming weeks to my brother and myself into two separate herd numbers, we have entitlements for the full farm area, question I have is if all the entitlements were transferred to lets say me then could I stack these on my area of land? Could my brother then apply to the national reserve for entitlements on his land? or would they still be linked back to my fathers reference years?

    To be honest op you need to be talking to an advisor as this is a bit of a grey area

    Maybe this is for advisor as well but I'll ask anyway.....if a father leases 100 acres of land and the entitlements connected to that land to son now, can the son claim the SFP on those entitlements this year?

    The son was not an active farmer in 2013 or 2014.

    No I don't think so. Because he is artificially creating naked land. As far as I'm aware he wouldn't get anything when he applied. You could sell him the entitlements back next year!

    I've caused the confusion I know but you einn32 are you answering OP or me?

    In my scenario as far as I can make out there is no naked land as land AND entitlements are being leased.

    If you lease entitlements with land with a pcc all is good. If you lease land without entitlements to son or anyone who intends on applying to national reserve the entitlements on that land will be lost.
    If you lease land to someone without entitlements and that someone isnt applying to national reserve you can consolidate those entitlements (spread over existing entitlements)

    What ever you do get advise, because its a grey area. Also what ever your advisor says, ring the department enquiry line to double check 1890 200 560 I was only on to them yesterday. Pretty helpfull.

    Sorry phone died. Was referring to the other persons' question. SFP is replaced with the Basic Payment System now. Yes you can once you apply for the BPS. You might qualify for a top up on the young farmers scheme too. But go to an advisor who knows your situation. There is no blanket advice for these schemes.

    Yes he can. Closing date for top up is end march. This is about €60 per hect up to 50 hectares.I think the value will be brought up to national average if not already there also. Apply for herd number ASAP and fill out lease agreement.

    As far as I know entitilments must go with land. This is a very serious time for farm payments, so speak to an advisor NOW. Land transfer takes time so consider leasing the land and get set up quicker for top up/nat reserve/new entrant schemes. The land can be transferred before year end and this will void the lease. Talk to advisor.
