Change of computer data/deletion of computer data

    Hi,

    Does the Irish Law or any data protection rules provide anything in respect of the change/deletion of computer data for such a case:
    • Data is generated by customer and placed into a database.
    • The database is not under the control of the customer. It is physically out of the customer's access (e.g. in a cloud), the customer has also no administrative privileges for the database.
    • Third party with physical access and administrative privileges deletes/changes data sets on purpose.

    Yes, broadly the EU regime for DP is in place.

    Ireland has its own data protection acts which implement the EU directives. You can find them here, along with various related statutory instruments:

    Here is the Irish legislation its been around for a while.

    Initial legislation – The 1991 Act
    The initial legislation attempting to deal with the area, the
    Criminal Damage Act 1991 (the “1991Act”), set the scene in the Section 1 interpretations by including data within the definition of
    ‘property’.
    It then went on to define data as “information in a form in
    which it can be accessed by means of a computer and includes a program”. Finally, it included reference to data within the
    definition of “to damage” and expressly, firstly, the addition, alteration, corruption, erasing and movement of data and secondly, the doing of acts contributing to the foregoing.
