    Ive put up a wall on the boundary but i need to put a gutter on it
    the gutter will over hang a inch or more into the next garden can i do this ??

    As the answer is no, and if there is a need to deal with water run off you need to decide how you will deal with this because if you allow roof run off to go into your neighbour garden they have a right to have it remedied at your expense, along the lines outlined here:
