How far back can revenue claim tax

    Hi

    My girlfriend noticed her monthly salary was €50 short in both January and February.

    She asked accounts in work and they informed her that revenue were taking it off each month for the whole year as she underpaid tax by €600 back in 2007.

    1: Are revenue allowed do this without at least informing her of the underpayment (Which is no fault of hers, she's a PAYE worker that assumes her workplace/revenue are doing their jobs correctly!)

    2: Are they allowed take the money from this far back off her? (8 years ago).
    I know we as PAYE workers can only claim back against revenue for the last 4 years!

    As far as they like I think! As to them informing her it could be on the letter she got telling her about her tax credits this year and if shes using PAYE online she might only get that electronically. We just get the four years to claim back. Might be worth her while getting a P21 for the past 4 years to make sure there is nothing else and if she's lucky maybe a few quid back or if unlucky owe the taxman :eek:.

    As to the correct tax being taken off it is the company who do it yes but its up to you to make sure that its right.

    No, Revenue will not usually go back more than 4 years unless there's something specific arising out of an investigation.

    Also, the employer will only get a summary of tax credits, not a full tax credit certificate like your partner would have received, and they should not know the details of why it has been reduced. Your partner needs to contact Revenue herself and ask them what the exact situation is.

    It is the worker's responsibility to check that their tax credits are correct, not their employer's.

    Usually where this happens is the underpayment is spotted within 4 years and set up to be collected within the usual timeframe, but for whatever reason it doesn't so they keep bumping it forward til they get it.

    Eg.

    You have an underpayment in 2008 of €1000, then in 2011 you get a review done and the underpayment shows up. Revenue will set it up to be collected in 2012, but if you a) dont have a job, or b) don't earn enough to pay tax in that year then it won't be collected, so when they spot that they will just bump it into the next year to be collected then.
