can emploer fire me for not agreeing to shift change as it will break a court order

    Hi,

    I would really appreciate some view on this.

    I currently work a job that has me work mon to friday 9-5 and then one weekend a month and two days off during that week in lieu.

    I also have a court order regarding access for me child that sees me take her 3 weekends a month.

    The current roster has been in place for a while and works great with the court order as thats how we came to this arragement.

    However a new vendor has taken over our job and now wants me to work two weekends a month instead of one and shift work during weekdays.

    I have advised that i am unable to do this due to the court order and my child in school and access with my child during weekdays on shift work will not work and they have said if i do not comply i will receive 30 days notice of terminate of emplyment due to not meeting the business needs.My orignal contract states i may be required to work additonal hours from time to time

    Can this be done? I have worked for the company for 7 years but this new vendor has taken over from the last one only 2 months previous

    can you get the access order changed to facilitate the new working arrangement.

    Shift patterns change all the time ... and as an employee you probably should be expected to be flexible.

    the would mean taken my child only two weekends a month then when im not working as she is in school during week days and i woulnt be happy with that

    You should really talk to a solicitor (even if you have to pay) if you have explained the situation to your employer and he doesn't care about your situation you might be able to walk him into a massive compensation payout.
