    Hi, I hope someone can help.
    My husband receives a JA payment and it is means tested. I have been out of work and the benefit reflected this but now I am going back part time. Approx 20hrs. These hours are flexible so my question is should I do these hours over for example 3 days yo help keep our benefit as high as possible.
    Also, what determines if I can receive FIS payment?

    You have lots of options. 1. You can remain on your husbands claim and any earnings will be assessed as means against his claim.
    2. You can open your own casual claim once you are working 3 days or less and hand in dockets each week. You will still only receive the same amount as a family unit whether you both have claims or only one claim. You can apply for FIS you have to be working an average of 19 hrs per week. Any payment your spouse has on jsa will be assessed for FIS. .
    3. Your spouse could close his claim and you could open a claim and be the main claimant and apply for FIS also.

    From your info I am assuming I cannot qualify for FIS while on my husband's claim?

    You can apply for FIS while on your husbands claim. His payment on JSA will be assessed for FIS. The dept will tell you which your best option is. If you are awarded FIS then the adult dependant will be removed from your husbands claim and he will receive half rate for the children and the means from your employment assessed against your spouses claim will be halved.
