car accident

    I had an accident on the 18th of december i wasnt at fault, insurance dragging their heals something serious was. suppose to have a rental car before xmas and they still havent approved it so im without one 25 days now. other party has admitted liability and i have a claim number. what can i do next legally speaking. im really fed up at this stage.

    Speak to a solicitor.

    I'm afraid the charter precludes any other answer given this is a real scenario. EIther that or make an official complaint to the ombudsman.

    i havent got the money to pay for a hire car right now will a rental place take a claim number from me in lue? the garage is under the impression i need approval for a hire car and this is the problem the company wont return emails or phonecalls, its getting very distressing, im a mature nursing student with 3 kids ive exams this month starting next tuesday so need a car by then. im already stressed out without this hassle never come across a company like them in my life

    Are you dealing with your insurance company or theirs? If its theirs quit it now and ring your own. They should arrange everything for you and then claim it back from the other company. If its your own company screwing you tell them you'll be going to the ombudsman.

    Keep all bus and taxi reciepts. You'll be able to claim out of pocket expenses.

    ive already been on to my insurance they wont do anything because i only have third party. its her companies insurance people im dealing with a very strange set up when you ring the irish number your put through to a uk insurance company. and they are the most unpleasent feckers ive ever had to deal with. i was just speaking to an insurance underwriter who said i shouldnt have been waiting more than a day for car hire never mind 25 days just dont know where to go from here. going to the solicitor still doesnt get my car fixed now

    You and the OP (given that there are two different accounts) where given the correct info by my post. If you don't want to go to the cost of a solicitor the ombudsman is there to handle complaints, as it seems you're not getting anywhere with the insurance company themselves. A solicitor would be the order of the day if you want something done with more urgency.

    My post was worded very carefully as to be general and not directed at anyone in particular. Your apparent propensity to take umbrage might be a reason you're not getting very far with the phone support. You've also been given terrible advice in this thread, humorous (barely) intended or not.

    What do you want from the insurance company?
    Write it down ring them note who you speak to and ask them when you are going to get it.

    Be very calm but clarify everything and ask for time frames. Ask how money will be paid and who to call if it is not and when.

    Note your objective of the call and work to a solution.

    It was aimed at people in general who think making things up with insurance companies is a good idea. Only you know if that's true of yourself. You seemed to be playing along with ill informed advice, which is your right of course.

    You asked for legal advice not practical advice, I answered your question succinctly, politely and correctly within minutes of you posting. I'm sorry that you didn't like my tone or lexicon but there we are.

    Practically there is very little you can do. Personally I've found making sure the garage is approved by both your and the other parties insurance works. Even if you're fully comp. I found it's better to go it alone as if you register the claim with your insurance, even if you're not at fault it can have (temporary) negative consequences. Personally I'd have not left the car (if it was drivable) with the place to be fixed until they had a hire car for me but all this is useless info to you now.

    Again best of luck - Zambia gave you some excellent advice. I'd suggest politely throwing the ombudsman into the mix and asking them what you need to do to exhaust their formal complaints procedure first - it will no doubt involve writing to them.
